Terms & Conditions

Three things fall under these terms: requests submitted through cmmcalibrationmilwaukee.com, the quotations issued in response to them, and the performance of CMM Calibration and related work arranged through this site. Acceptance is by conduct — submitting a request, or accepting a quotation issued in response to one. Where a signed supply agreement or agreed purchase-order terms are already in place, that agreement takes precedence over these terms to the extent of any conflict.

Every request is reviewed before a quotation is issued. That review confirms that the requirement is stated clearly and understood, that the method, range and measurement capability needed are available, and that the laboratory selected to carry out the work is competent to perform it.

Where a statement of conformity is required, the decision rule to be applied is agreed in writing before work begins, together with the specification the item is to be assessed against. If a requirement changes after acceptance, the review is repeated and the change is confirmed to the customer before work continues. Requests that cannot be met as specified are declined, or returned with an alternative scope — never accepted and quietly reduced.

Quotations are issued in writing, and each holds for thirty (30) days from the date of issue unless the quotation itself states a different period. What it is built from is the item description, quantity, measurement points, tolerances and turnaround supplied with the request.

Any item that arrives differing from the item described changes the position — additional channels, a wider range, damage, or a condition needing repair before measurement is possible. Work is held while a revised quotation is issued, and nothing proceeds until that revision is approved in writing.

Business days are how turnaround is quoted, and it runs from receipt of the item or receipt of written approval to proceed, whichever is later. Expedited handling is possible where capacity allows and is quoted separately. Every turnaround commitment is given in good faith against current capacity; if it cannot be met, notice is given as soon as the delay is known, stating a revised date.

Packaging adequate for transit is the customer's responsibility, along with any accessories, fixtures, cables or software the work needs. Transit risk runs with the customer in both directions unless carriage has been arranged and charged on the quotation.

Anything unsafe, contaminated, or outside the condition accepted at review goes back unworked, and the reason is stated. Completed items sit at the customer's risk after the collection or despatch period agreed on the quotation.

Release of certificates and items follows payment in full, except on a credit account approved in advance, where invoices are payable net thirty (30) days from the date of invoice.

Taxes, duties and carriage are excluded from prices unless the quotation states otherwise. Where a balance is overdue, interest may accrue at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law, and further work may be suspended for as long as the account remains overdue.

The certificate or report comes from the laboratory that performed the work and stays that laboratory's technical record. On payment in full the customer holds an unrestricted right to keep it, copy it, and use it for its own quality, audit and regulatory purposes.

Reproduction is permitted in full only; partial reproduction requires written approval, and the certificate is issued as a complete document for that reason. Copies are retained for the period stated in the performing laboratory's records policy, and a reissue carries the original certificate number.

Information obtained or created in the course of a request is confidential, and that covers drawings, specifications, tolerances, measurement results and the existence of the engagement itself. Only the personnel and providers who need it to complete the work are given it. Disclosure required by law is made, as is disclosure to an accreditation body exercising its rights of access, and the customer is notified of a legally required disclosure unless that notification is itself prohibited.

Reasonable skill and care are applied to the work, in accordance with the methods and standards stated on the quotation and on the resulting certificate. Where work is shown to be defective, the customer elects the remedy: re-performance of the affected work, or a refund of the amount paid for it.

Total liability arising out of any engagement is limited, to the maximum extent permitted by law, to the amount paid for the work giving rise to the claim. No liability is accepted for loss of profit, loss of production, loss of contract, or any indirect or consequential loss. Liability that cannot be limited by law is not limited by anything in these terms.

These terms are governed by the laws of Wisconsin, without regard to conflict-of-law principles, and any claim is brought in the courts of that jurisdiction unless a different forum has been agreed in writing.
